"THE INTERNET MOON" - TERMS OF TRANSFER OF SPACE

DEFINITIONS

PROVIDER is the company "The Internet Moon LLC", which is based on United States and operates internationally by means of Internet hosted services. SITE is the web site and set of services hosted at the Internet domain and subdomains under "theinternetmoon.com", which belongs to the PROVIDER. SPACE is a single contiguous, delimited, well-defined and fixed-size area in the surface of the virtual sphere that the SITE presents to users. SPACE is also the object of the TRANSFER. YOU are/is the current owner of the SPACE, the person or entity that can sign in and use the SITE to manage the SPACE, including specifying its contents. RECIPIENT is the intended future owner of the SPACE, which may become effective owner in case the TRANSFER is completed. The RECIPIENT is a person or entity that is fully chosen by YOU, and it may even be yourself with a different representation (i.e. email address) towards the SITE. TRANSFER is the operation initiated by YOU voluntarily, which changes the ownership of the SPACE from YOU to the RECIPIENT, and is performed by the PROVIDER with or without automated processes.

TRANSFER TERMS

1. YOU have the right to initiate a TRANSFER, and YOU are not required to do so. YOU agree that YOU are not being incentivized or pressured by the PROVIDER or SITE to perform a TRANSFER.

2. The TRANSFER is an operation that allows YOU to do business, charity, fulfil agreements or exercise certain forms of freedom with the SPACE that YOU own. For example, YOU may want to sell the SPACE to the RECIPIENT, and therefore perform a TRANSFER after you receive a payment that YOU and the RECIPIENT have agreed upon. However, YOU will not receive any refund from the PROVIDER for the TRANSFER, or for loosing ownership of the SPACE. Any value or fee that you have paid for the SPACE or for changing or maintaining it, directly or indirectly to the PROVIDER, will stay final and definitive even with the advent of a TRANSFER. Transferring is a voluntary action from YOU, and it does not entitle YOU to receive any form of compensation from the PROVIDER.

3. By initiating the TRANSFER, YOU voluntarily and immediately renounce all money-back rights given by the PROVIDER to YOU about the SPACE. This includes the money-back guarantee given for the purchase of the SPACE from the PROVIDER, and other money-back guarantees given to YOU by the PROVIDER for reversible services or promotions applied to the SPACE. This comes from the fact that once the TRANSFER is complete, YOU will not have ownership of the SPACE and therefore the right to return the SPACE to the PROVIDER, or to reverse any service or promotion applied to the SPACE. If the TRANSFER is cancelled, or if after the TRANSFER is complete the SPACE goes back to your ownership, by means of, for example, another transfer operation or manual action from the PROVIDER, all money-back rights that YOU had before the TRANSFER started will be restored, except for the number of days that passed after the TRANSFER started. Example 1: YOU have 20 days left of money-back rights when YOU initiate a TRANSFER and it is cancelled after 2 days: YOU will retain 18 days left of money-back rights (20 - 2 = 18). Example 2: YOU have 20 days left of money-back rights when YOU initiate a TRANSFER; then after 1 day the TRANSFER is complete; then after 30 days, the RECIPIENT or the PROVIDER returns the SPACE to YOU: YOU will not have any money-back right (20 - 1 - 30 = -11, -11 < 0). Example 3: YOU have 20 days left of money-back rights when YOU initiate a TRANSFER; then after 1 day the TRANSFER is complete; then after 10 days the RECIPIENT or the PROVIDER returns the SPACE to YOU: YOU will have 9 days left of money-back rights (20 - 1 - 10 = 9).

4. Before the TRANSFER is complete, any recurrent charge that is applicable for a service that YOU purchased from the PROVIDER for the SPACE will remain effective. Immediately after the TRANSFER is complete, all services that YOU purchased from the PROVIDER for the SPACE will be terminated, and all upcoming recurrent charges will be cancelled as well. The one-time payment that YOU made to the PROVIDER for the SPACE is not considered a recurring charge, and as previously stressed, YOU will not receive any refund for it.

5. Once the TRANSFER is complete, YOU will not have ownership of the SPACE. YOU agree with full or partial removal, deletion or modification of any content displayed in the SPACE or activated by interactions with the SPACE. This includes past, existing and future content. YOU allow the PROVIDER and RECIPIENT to perform changes in the SPACE any time, including 1) immediately after YOU start the TRANSFER, 2) any time between the moment YOU start the TRANSFER and the moment the TRANSFER is complete; and 3) any time after the TRANSFER is complete. YOU also allow the PROVIDER and RECIPIENT to not change the SPACE at all, which means the current content and behavior of the SPACE, possibly specified by YOU, may be displayed indefinitely, even after the TRASNFER is complete and YOU don't have ownership anymore and cannot change the space anymore.

6. While the TRANSFER is not complete, YOU will continue to own the SPACE and held responsible for its content. In case the SPACE contains unauthorized material, or the account that belongs to YOU is found to be associated with unauthorized activities, YOU may lose the ownership of the SPACE and the TRANSFER may be cancelled.

7. YOU agree that the SITE have displayed to YOU exactly which SPACE will be subject of the TRANSFER, which is especially useful in case you own more than one, and that YOU did not initiated the TRANSFER of any space by accident.

8. If YOU want to perform a TRANSFER of multiple spaces, YOU must repeat the procedure for each space. Each TRANSFER may be subject to different terms, depending on parameters such as space, time of start, time of completion, recipient, applied promotions and services, and other parameters. Each transfer may or may not complete, independently of the state of other transfers.

9. The SITE or the PROVIDER may present, to YOU or to the RECIPIENT, instructions with additional steps that need to be performed to complete the TRANSFER. The PROVIDER is not responsible for lack of action or mistakes from YOU or from the RECIPIENT.

10. Once the TRANSFER is initiated, it cannot be cancelled by YOU or by the RECIPIENT. It may be cancelled if the RECIPIENT fails to perform the required actions, by omission, mistake or intentionally. It may be cancelled by the PROVIDER any time. If the TRANSFER is cancelled, the SPACE ownership will not be changed, and YOU will stay responsible for the contents and any active recurrent charge. Depending on the reason for the cancellation, YOU may or may not have right to perform another transfer in the moments or days that succeed the cancellation.

11. The PROVIDER is not responsible for errors, mistakes or miscommunications from YOU, that may cause the SPACE to be transferred to the wrong person or entity, or that may cause the SPACE to be transferred before the RECIPIENT fulfils any condition that YOU may have specified for the transfer, including but not limited to receiving a payment.

12. The PROVIDER is not responsible by any agreement or fulfillment, or lack of thereof, between YOU and the RECIPIENT, even in face of technical difficulties with the TRANSFER. YOU accept that the TRANSFER use automated systems or manual methods that are subject to failure, and that while the PROVIDER will make efforts to complete the TRANSFER, there is no guarantee, SLA (Service Level Agreement) or similar obligation that incurs into any responsibility for the PROVIDER to complete the TRANSFER within any specific time period.

13. In order to receive the SPACE and associated rights, the RECIPIENT will have to agree with terms from the PROVIDER. These terms might differ from the terms YOU have agreed upon when YOU received the space. Plus, the SITE may present to the RECIPIENT features and functionalities for using and managing the SPACE, different than the features and functionalities that YOU have today. The PROVIDER is not responsible for any action or decision that the RECIPIENT might have or impose to YOU in face of such changes, and will not be able to reverse or cancel the TRANSFER after it completes. In order to prevent undesired situations, it is strongly recommended that YOU ask the RECIPIENT to review the PROVIDER terms by clicking on the "Terms of Service" link in the SITE before any commitment.

14. The TRANSFER is final and definitive. YOU accept that the SITE does not offer features or controls that allow YOU or the RECIPIENT to reverse or cancel the TRANSFER after it is complete, and that the PROVIDER is not obligated to reverse or cancel the TRANSFER at your request, or at request of the RECIPIENT.

15. The RECIPIENT may or may not get the rights to transfer the space back to YOU or to any other person or entity. If the RECIPIENT gets this right, YOU accept that the RECIPIENT must agree about any further transfer, and the RECIPIENT must do it explicitly, correctly and using only the controls that the SITE exposes, without special help from the PROVIDER.

16. In case the SPACE gets back to your ownership in the future for any reason, or to any other person or entity, YOU or the person or entity may be subject to terms, rights and SITE features and functionalities at your SPACE, different than those that YOU have right now.

17. YOU accept that the RECIPIENT will have freedom (subject to our terms) to put the content they want in the SPACE. The content may or may not be associated or related to the content that was placed by YOU while YOU were the owner. The PROVIDER is not responsible for any derogatory or other specific aspect that the new contents may have in relation to YOU, any organization that you represent or any previous content. Although the PROVIDER monitors content for abuse and unlawful use, YOU accept that the remediation may not be immediate and may take days to be effective. The PROVIDER will retain the right to evaluate and determine if the content is abusive or not, and YOU understand that due to subjective nature, the outcome may not be the one YOU desire.

18. The links that YOU have shared may keep highlighting the SPACE, but the contents will be defined by the RECIPIENT or any future owner. It is also possible that the links that YOU have shared will display a message to the visitors instead of highlighting the SPACE. The actual outcome depends on technical aspects of the links that YOU have shared.

19. The PROVIDER may choose to reject the transfer to the RECIPIENT that you specify. We will do this actively for cases where the RECIPIENT was found committing fraud or abuse, or being negligent with our terms, or for any other reason we deem pertinent. In that case, the SPACE will remain belonging to YOU, and PROVIDER will not be responsible for any lack of agreement or fulfillment between you and the RECIPIENT.
